Brookville to annex Perry Township land

BROOKVILLE — Council approved three resolutions toward the annexation of 113.562 acres of land in Perry Township.

The approved resolutions come on the heels of a petition for annexation of the property to Brookville that was filed in the office of the clerk of the Montgomery County commissioners so an area church can build a meeting and activity center and a single-family house on the land.

The land petitioned to be annexed is located between Heckathorn Road and the Wolf Creek bike trail.

The three approved resolutions are:

• Resolution 23-20: provides for the municipal services to be provided to the area if the annexation is approved.

• Resolution 23-21: requires the establishment of a buffer in the event the municipal zoning would permit uses in the annexed area that are clearly incompatible with current county or township uses in land adjacent to the annexed area.

• Resolution 23-22: provides that the City of Brookville consents to the proposed annexation.

“These resolutions are being passed in emergency to meet the time requirements of Ohio Revised Code 709.023 for expedited type 2 annexations,” Brookville Law Director Rod Stephan said.

Stephan said annexing the land to Brookville will enable the proposed facility and the single-family house to receive water and sewer services from the city.

“How much space is projected for the recreation center and the residence?” council member Curt Schreier asked Stephan.

“I would estimate approximately 10 to a maximum 15 acres,” Stephan replied.

Stephan added council would take further action to determine the zoning if additional development was proposed in the future.

But Stephan said no further housing or business development on the remaining land is planned at this time.

Council member J.D. Fowler asked Stephan the layout of the proposed development.

“The rear of the development will be toward the bikeway. We’re looking at a significant setback from the bikeway,” Stephan said.

“There will be a private drive off Heckathorn which would enter into a parking area at the right. The house will be built to the left of the private drive,” Stephan added.

Stephan noted even though the land will be annexed to Brookville, Perry Township will continue to receive taxes from the property.

“That includes any property taxes generated by development on the property,” Stephan said.
